Terms and conditions

1. Application and supplier
The General Terms and Conditions of Business below apply to all purchase contracts as amended at the time of order concluded with its customers by Cleanophily (hereinafter referred to as "Cleanophily") as the seller of goods in its webshop.
By placing the order, the customer understands that the present business transaction is made exclusively on the basis of these General Terms and Conditions of Business and Delivery.
Any deviating terms and conditions of business of the customer do not apply. Provisions deviating from the General Terms and Conditions of Business and Delivery shall only be valid if specified in writing.
If any provisions of these General Terms and Conditions of Business are contrary to mandatory legal provisions in whole or in parts, the other provisions of these GTC shall remain valid.

2. Conclusion of contract
The presentations of the products in the online shop serve the purpose of submitting a purchase offer. By clicking on the (Order now) button, the customer places a binding purchase offer.
Cleanophily may accept the order by sending an order confirmation by e-mail or by delivering the goods within five days. This confirmation of receipt of order is made by an automatically generated e-mail immediately after the order has been sent and does not represent an acceptance of the contract.
If Cleanophily is unable to accept the customer's purchase offer, the customer will be informed that the goods are not available.
The language of contract shall be German. German is also the language of any other information, our customer service and complaint management.

3. Prices
The price as given in our current offers on the website shall generally be deemed the agreed purchase price of the ordered goods. Prices are ex Cleanophily including value-added tax.
Shipping costs will be charged extra.
Cleanophily is entitled to determine the means of transportation.
Deliveries within Austria and the EU will be charged according to the general freight charges and business conditions of Österreichische Post AG per order/carton/parcel.
Deliveries to other countries may be subject to additional customs duties, taxes and charges.

4. Retention of title
Cleanophily reserves the title to the goods delivered until payment of the purchase price has been made in full. In the event of the customer reselling the goods, the retention of title will be extended and it is herewith agreed that the customer assigns any claim resulting from the resale vis-à-vis his customer to Cleanophily.

5. Warranty and damages
Cleanophily makes every effort to manufacture its products with the utmost care.
Consumers as defined in the Austrian Consumer Protection Act are granted statutory warranty by Cleanophily.
Cleanophily shall be notified of any complaints in writing without delay upon receipt of the goods, failing which warranty and liability will be excluded.
Cleanophily shall only be liable for damage caused by culpable violation of contract if the violation was caused at least by grossly negligent conduct of its staff or vicarious agents. The amount of liability shall in any case be limited to half the purchase price that is the subject of liability. This shall also apply to cases of default or when performance is impossible. Consumers as defined in the Consumer Protection Act will be granted statutory damages.

6. Right of withdrawal
Consumers as defined in the Consumer Protection Act are entitled to withdraw from the purchase contract within fourteen days without stating reasons.
The term of withdrawal is fourteen days from the day on which the customer or a third party named by it, who is not the transporter of the goods, has taken possession of the goods.
In order to exercise his right of withdrawal the customer shall notify Cleanophily Sariastraße 9, 9020 Klagenfurt am Wörthersee, +43 650 50590 05, [email protected] of his decision to withdraw from this contract.
The declaration of withdrawal shall be without any form requirement as a matter of principle, but a procedure according to the withdrawal form on this website is recommended.
The purchase price will be reimbursed against return of the new, undamaged goods. The costs of sending the goods back to Cleanophily shall be borne by the buyer if the original total order value of a delivery that is the subject of withdrawal is less than 40 euros (excluding flat shipping rate). In all other cases the costs of returning the goods will be borne by Cleanophily.
If the goods are damaged or impaired by signs of use, the customer is to pay an adequate compensation for impairment of value, if the loss is due to any handling of the goods that was not needed to check the condition, properties and functioning of the goods. The same applies if accessories or parts are missing when the goods are returned.

8. Advertising
By placing his order, the customer agrees to receive occasional e-mail information about Cleanophily products. The receipt of such e-mail messages can be cancelled any time and each time an e-mail is received by sending an e-mail to [email protected].

9. Final provisions
The place of fulfilment for both parties shall be Klagenfurt am Wörthersee. Klagenfurt am Wörthersee is agreed as the legal venue. Austrian law applies exclusively. If a customer is a consumer as defined in the Consumer Protection Act, any legal disputes shall be submitted to the court that has jurisdiction over the customer's place of residence, habitual residence or place of work.
